Privacy Policy

This Privacy and Personal Data Processing Policy explains how we collect, use and protect your personal data when you use this website, in compliance with Colombian Law 1581 of 2012 and Decree 1377 of 2013 (compiled in Decree 1074 of 2015) and, where applicable, the EU General Data Protection Regulation (GDPR) and U.S. privacy laws.

APRIL 13 STUDIOS SAS is the controller of the personal data collected through this site, including on behalf of other April 13 Studios group entities.

2. What we collect and why

  • Contact form: name, email address, subject and message. Purpose: to answer your inquiry and follow up on the conversation (press, partnerships, support, etc.).
  • Newsletter: email address. Purpose: to send you news about the studio and Scrap Core (development updates, launches and devlogs). We use double opt-in: we email you a link and you are only subscribed once you confirm it.
  • Technical data: IP address and browser type, processed by our server. Purpose: to deliver the site, keep it secure and prevent abuse (for example, limiting mass form submissions).
  • Essential language cookie: remembers the language you chose. See our Cookie Policy.

We do not request sensitive data (health, ethnic origin, political opinions, biometric data, etc.); please don't include it in your messages. This site is not directed to minors, and we do not knowingly process their data. If you are a parent or guardian and believe a minor has sent us information, contact us and we will delete it.

3. Authorization

Before you submit any form, we ask for your prior, express and informed authorization through a checkbox. We keep proof of that authorization (date and accepted version of this policy). You can withdraw it at any time.

For users in the European Economic Area and the UK, our legal bases are your consent (newsletter), handling your request, and our legitimate interest (answering messages and keeping the site secure).

4. Your rights

Under Article 8 of Colombian Law 1581 of 2012 you may:

  • Know, update and correct your personal data.
  • Request proof of the authorization you gave.
  • Be informed of how we have used your data.
  • Withdraw your authorization and/or request deletion of your data.
  • Access your personal data free of charge.
  • File complaints with Colombia's Superintendence of Industry and Commerce (SIC), once you have completed the inquiry or claim process with us.

If the GDPR applies to you, you also have the rights to restriction, objection and data portability, and to lodge a complaint with your supervisory authority. California residents have the right to know, delete and correct their information. We do not sell or share your personal information for advertising.

5. How to exercise your rights

Email contact@april13studios.com with the subject "Habeas Data", including your name, ID document, a description of your request and an email address for our reply. Requests, inquiries and claims are handled by the Management of APRIL 13 STUDIOS SAS.

  • Inquiries: answered within ten (10) business days. If that isn't possible, we will tell you why and give a new date, no more than five (5) business days later.
  • Claims (correction, update, deletion or a breach): handled within fifteen (15) business days, extendable by eight (8) business days with notice. If a claim is incomplete, we will ask you to complete it within five (5) days; after two (2) months without a reply, it will be considered withdrawn.

6. Processors and international transfers

We use a small number of providers who process data only to deliver their service, under confidentiality and security obligations:

  • Resend (United States): sending contact-form and newsletter emails.
  • Hetzner Online GmbH (Germany): server infrastructure hosting the site.

Your data may therefore be processed outside Colombia. The United States and EU countries are among the countries recognized as providing an adequate level of protection under the Colombian SIC's External Circular 005 of 2017, and for European users we rely on appropriate contractual safeguards.

7. Retention

  • Contact messages: as long as needed to handle your request, and at most two (2) years after our last exchange.
  • Newsletter: until you unsubscribe or withdraw your authorization.
  • Technical security data: kept briefly in memory (minutes) and in server logs for a short period.

Our databases remain in force for as long as the purposes above and the operation of APRIL 13 STUDIOS SAS continue.

8. Security

We apply reasonable technical and organizational measures: encrypted connections (HTTPS), data minimization (this site has no database of its own), form validation and restricted access to the inboxes where your messages arrive.

9. Newsletter emails

Every email includes an unsubscribe link and our physical address. We respect the sending hours for marketing messages set by Colombian Law 2300 of 2023.

10. Do Not Track

We do not track your activity over time or across other sites, and we do not allow third parties to do so through this site. Since no tracking takes place, the site does not change its behavior in response to "Do Not Track" or Global Privacy Control signals.

11. Changes to this policy

If we make material changes, we will post them on this page before they take effect and update the effective date. This version is effective as of 2026-10-03.

This policy is published in several languages; in case of any discrepancy, the Spanish version prevails.
